Agreement to Terms

Welcome to Yonoco. By accessing or using our mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

Privacy Policy Integration

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection, use, and disclosure of your personal information, including location data.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Yonoco and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Yonoco.

User Accounts and Eligibility

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You must be at least 13 years of age to use our Service. By using the Service, you represent and warrant that you meet this age requirement.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Location Services and Travel Data

By using our Service, you acknowledge and agree that:

• Location permissions are required for core functionality including mapping, check-ins, and travel tracking
• You can control location sharing granularity through app settings
• Travel history and visited places are stored according to your privacy preferences
• Location data may be shared with other users based on your chosen privacy settings
• Background location access requires explicit opt-in and can be disabled at any time

User Content and Travel Information

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, travel reviews, location check-ins, or other material ("Content"). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, you represent and warrant that:

• The Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms
• The posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person
• Travel reviews and location information are accurate to the best of your knowledge
• Photo and video content was legally captured and you have rights to share it
• Location data and check-ins reflect actual visits and experiences

Social Features and Community Guidelines

When using social features of our Service, you agree to:

• Respect other travelers and their privacy
• Provide honest and helpful travel reviews and recommendations
• Not share misleading location or travel information
• Respect local laws and customs when sharing travel content
• Not use the platform for commercial promotion without prior consent
• Report inappropriate content or behavior to our moderation team

Content License and Usage Rights

By posting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your Content in connection with the Service, including for promotional purposes, subject to your privacy settings.

You retain ownership of your travel data, photos, and personal content, but grant us the right to display and share this content according to your chosen privacy settings.

Prohibited Uses

You may use the Service only for lawful purposes and in accordance with the Terms. You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To share false location data or misleading travel information
• To stalk, harass, or harm other travelers based on location or travel information
• To use location data for any surveillance or tracking purposes beyond the intended social features
• To circumvent location privacy controls or access restricted travel data

Data Security and Retention

We implement reasonable security measures to protect your travel data and personal information. However, you acknowledge that no method of transmission or storage is completely secure.

Your travel data is retained according to the policies outlined in our Privacy Policy. You may request deletion of your travel history, account data, or specific content through the app settings or by contacting us.

Service Availability

We strive to maintain Service availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.

Location-based features depend on third-party mapping services and GPS functionality, which may be affected by technical limitations, geographic restrictions, or weather conditions.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. You may delete your account at any time through the app settings, which will remove your profile and travel data according to our data retention policies.

Third-Party Services

Our Service integrates with third-party services including mapping providers, points of interest databases, and analytics platforms. Your use of these integrated services is subject to their respective terms and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services integrated into our platform.

Limitation of Liability

In no event shall Yonoco, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content
• Loss or corruption of travel data or location history
• Inaccurate location data or mapping information
• Issues arising from location sharing or social features

Whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

We do not warrant that location data will always be accurate, that points of interest information will be current, or that travel recommendations will meet your specific needs.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except for disputes involving intellectual property rights or injunctive relief.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect through in-app notifications or email. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service and delete your account.
